Tinctery™ Terms of Service
Last Updated: September 27, 2026
IMPORTANT NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT, A CLASS ACTION WAIVER AND A MASS ACTION PROCEDURE THAT AFFECT YOUR LEGAL RIGHTS (SEE SECTIONS 19 TO 22). IF YOU LIVE IN THE UNITED STATES, DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS THROUGH FINAL AND BINDING ARBITRATION UNLESS YOU OPT OUT AS DESCRIBED IN SECTION 21.
1. Acceptance of Terms
These Terms of Service ("Terms") are an agreement between you and Tinctery ("Tinctery," "we," "us" or "our"). They govern your use of tinctery.com, any related pages, checkout pages and services (the "Website"), and any products or subscriptions you buy from us (the "Products").
By using the Website, creating an account, joining a subscription or placing an order, you confirm that:
- You are at least 18 years old
- You are legally able to enter into a binding agreement
- You agree to these Terms, our Privacy Policy, Refund Policy and Shipping Policy, which are part of these Terms
If you do not agree, please do not use the Website or buy our Products.
1.1 Electronic Agreement. Where we ask you to check a box or click a button to agree to these Terms, that action is your legally binding electronic signature.
1.2 Changes to These Terms. We may update these Terms at any time by posting the new version on this page. If a change is material, we will give you at least 30 days' notice before it takes effect. Changes will not apply to disputes that arose before the change. Continuing to use the Website after changes take effect means you accept them.
Our store is hosted on Shopify Inc., which provides the online platform that lets us sell our Products to you.
2. Important Health Information
The statements on this Website have not been evaluated by the Food and Drug Administration. Our Products are not intended to diagnose, treat, cure or prevent any disease.
Everything on the Website, including product descriptions, articles, emails, social media and customer reviews, is for general information only. It is not medical advice and is not a substitute for advice from a qualified healthcare provider.
Talk to your doctor before using our Products, especially if you:
- Are pregnant, nursing or trying to become pregnant
- Take any prescription or over-the-counter medication
- Have a medical condition, including heart, kidney, liver or blood pressure conditions
- Are scheduled for surgery
Stop using the Product and contact your doctor if you have any reaction. Use the Product only as directed on the label. Do not use it if the safety seal is broken. Keep it out of reach of children.
Results vary. Your results depend on factors unique to you, such as your age, health, diet, activity and how consistently you use the Product. We do not guarantee that you will reach any health or wellness goal. Any reliance on information on the Website is at your own risk.
3. Reviews and Testimonials
Reviews and testimonials on the Website reflect the individual experiences of real customers. They do not represent the typical or expected results for every user. Your results may be different.
4. Personal Use Only; No Resale
Products bought from us are for your personal, non-commercial use only. You may not resell, redistribute or export our Products, including on Amazon, eBay, TikTok Shop or any other marketplace. Products sold through unauthorized sellers may be old, altered, stored improperly or counterfeit, and are not covered by our Money-Back Guarantee. We may cancel orders, close accounts and take legal action against unauthorized resellers.
5. Orders and Acceptance
Placing an order is an offer to buy. Your order confirmation email does not mean we have accepted your order. We may refuse, limit or cancel any order at our discretion, including orders that:
- Appear to be fraudulent or placed by resellers
- Contain pricing, product or other errors
- Exceed quantity limits per person, household, payment method or address
- Include Products that are unavailable
If we cancel an order after you have been charged, we will refund you to your original payment method.
6. Prices and Product Information
Prices are shown in U.S. dollars unless stated otherwise and may change without notice. We try to display our Products, prices and information accurately, but mistakes can happen. We may correct any error and cancel affected orders, even after you place your order. Product colors may look different on your screen.
7. Payment
By providing a payment method, you confirm that you are authorized to use it and that your information is accurate. You authorize us to charge your payment method for your order, including Products, shipping, taxes and any other fees shown at checkout. We are not responsible for fees your bank or card issuer charges you.
8. Subscriptions and Automatic Renewal
8.1 How Subscriptions Work. When you join a subscription, you agree that we will automatically charge your payment method and ship your Products at the frequency and price shown at checkout until you cancel. Before you finish your purchase, we will clearly show you:
- That your subscription renews automatically until you cancel
- How often you will be charged and shipped
- How much you will be charged each time
- How to cancel
You must actively agree to these subscription terms before your purchase is completed. After you sign up, we will email you a confirmation with your subscription terms and how to cancel.
8.2 Renewal Reminders. We will email you a reminder before each renewal charge, so you are never surprised.
8.3 How to Cancel. You can cancel at any time. To avoid your next charge, cancel at least 24 hours before your next billing date. You can cancel:
- Online through your customer account or the link in your subscription emails
- By email at hello@tinctery.com
You will never have to call us or speak with anyone to cancel. When you cancel, we may show you one offer to stay, which you are free to decline. Once you cancel, no future charges or shipments will be made.
8.4 Price Changes. If the price of your subscription changes, we will email you at least 7 days before the new price applies. You can cancel before the change takes effect.
8.5 Failed Payments. If a renewal payment fails, we may retry the charge, contact you for updated payment information, and pause shipments until payment goes through. Our payment processor may use an account updater service to update your card details if your card issuer provides them.
8.6 Subscriptions and the Money-Back Guarantee. The Money-Back Guarantee applies to your first order only. Renewal orders are not covered, but you can cancel future renewals at any time. Damaged or wrong items in any order are handled under our Refund Policy.
9. Shipping and Delivery
We ship to the United States, Canada, the United Kingdom, Australia and New Zealand. Processing and delivery times are listed in our Shipping Policy and are estimates, not guarantees.
You are responsible for entering a correct and complete shipping address. We are not responsible for delays, loss or failed delivery caused by an incorrect address. Packages returned to us as "return to sender" because of an address error or a refused delivery are not eligible for a refund.
Delivery confirmation from the carrier is proof of delivery to the address you gave us, even without a signature. Title and risk of loss pass to you when the carrier delivers your order to that address.
International customers are responsible for any customs duties, import taxes or fees charged by their country.
10. Money-Back Guarantee and Refunds
All refunds, replacements and our 30-Day Money-Back Guarantee are governed by our Refund Policy, including its eligibility rules, time limits and refund limits. Please do not mail Products back unless we ask you to. We cannot accept or refund returns we did not authorize.
11. Chargebacks
If you have a problem with your order, please contact us first at hello@tinctery.com. We will work with you to make it right. If you file a chargeback or payment dispute instead, we may:
- Share your order details, tracking, communications and these Terms with your bank or card issuer
- Cancel your subscription and any pending orders
- Refuse future orders from you
If a chargeback is decided in our favor, or you received the Products, you remain responsible for the amount owed.
12. Your Account
If you create an account, you must give accurate information and keep your login details private. You are responsible for all activity on your account. We may suspend or close accounts that break these Terms.
13. Prohibited Uses
You agree not to:
- Break any law or use the Website for any unlawful purpose
- Give false or misleading information, including in orders, refund claims or reviews
- Make refund claims in bad faith or under multiple names, emails or addresses
- Pretend to be someone else
- Upload viruses or harmful code, or interfere with the Website's security
- Scrape, crawl or copy the Website using automated tools
- Collect other people's personal information
- Harass, threaten or abuse our team or other customers
- Resell our Products without written permission
We may suspend or end your access to the Website if you break these rules.
14. Reviews, Comments and Submissions
If you send us or post reviews, photos, videos, comments or ideas ("Submissions"), you give us a free, worldwide, permanent license to use, copy, edit, publish and share them in any media, including advertising, together with your first name and last initial. You confirm that your Submissions are true, based on your own experience, and do not violate anyone else's rights. We may remove any Submission at our discretion. We do not owe you payment for Submissions.
15. Intellectual Property
All content on the Website, including the Tinctery™ name, logo, text, images, videos, graphics and design, is owned by or licensed to Tinctery and protected by copyright and trademark laws. You may not copy, reproduce, sell or use our content for any commercial purpose without our written permission.
To report copyright infringement, email hello@tinctery.com with the subject line "Copyright Infringement," a description of the work, the page where it appears, and your contact information.
16. Third-Party Tools and Links
The Website may include third-party tools, apps or links, including payment, review and shipping services. We do not control them and are not responsible for their content, policies or actions. Your use of them is at your own risk and subject to their terms.
17. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Website will be uninterrupted, error-free or free of viruses, or that any Product will meet your expectations or produce any specific result.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TINCTERY AND ITS OWNERS, EMPLOYEES, CONTRACTORS, SUPPLIERS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, including lost profits, lost data or loss of goodwill, arising from your use of the Website or any Product, even if we were told such damages were possible.
OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT BE MORE THAN THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.
Some places do not allow certain limits on liability, so some of these limits may not apply to you.
18.1 Customers Outside the United States. If you live in the United Kingdom, Australia, New Zealand or Canada, nothing in these Terms removes or limits any consumer rights or guarantees that cannot be excluded under your local law, including the UK Consumer Rights Act 2015 and the Australian Consumer Law. In those places, our liability is limited only as far as your local law allows. Sections 19 to 22 (arbitration) do not apply to you.
18.2 Time Limit for Claims. To the fullest extent permitted by law, any claim relating to these Terms, the Website or any Product must be filed within one (1) year after it arises, or it is permanently barred.
19. Dispute Resolution and Binding Arbitration (U.S. Customers)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
19.1 Talk to Us First. Before starting any formal claim, you agree to send us a written Notice of Dispute by email to hello@tinctery.com, or by mail to the address in Section 25. It must include your full name, mailing address, email used for your order, a description of the problem and what you are asking for. We will try in good faith to resolve it with you within 30 days before either of us starts arbitration.
19.2 Agreement to Arbitrate. If we cannot resolve it, you and Tinctery agree that any dispute relating to these Terms, the Website, any Product, any subscription, or our advertising or marketing will be resolved by final and binding individual arbitration, not in court. This agreement is governed by the Federal Arbitration Act.
19.3 Arbitration Rules. Arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before one neutral arbitrator. It may take place by video, by phone, based on written documents, or in the county where you live. The arbitrator can award the same individual relief a court could.
19.4 Fees. Filing and arbitration fees will follow the AAA Consumer Arbitration Rules. We will pay any arbitration fees that are more than what you would pay to file a case in court. Each side pays its own attorneys' fees unless the law or the arbitrator says otherwise.
19.5 Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may go to court for claims about intellectual property, unauthorized resale or fraud. Nothing here stops us from responding to chargebacks or collecting amounts owed as allowed by law.
19.6 Public Injunctive Relief. If the law does not allow a claim for public injunctive relief to be waived or arbitrated, that claim may be brought in court, after all arbitrable claims are decided. All other claims remain in arbitration.
20. Class Action Waiver and Mass Arbitration
20.1 Class Action Waiver. YOU AND TINCTERY AGREE THAT DISPUTES WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. The arbitrator may not combine claims from more than one person.
20.2 Mass Arbitration. If 25 or more similar arbitration demands are filed against us within 180 days by the same or coordinated lawyers, they will be handled in batches of up to 100, one batch at a time, with a separate arbitrator for each batch. Time limits for filing claims are paused while claims wait in the batching process.
21. Your Right to Opt Out of Arbitration
You may opt out of arbitration within 30 days of your first order by emailing hello@tinctery.com with the subject line "Arbitration Opt-Out," or by mailing us at the address in Section 25. Include your name, mailing address, the email used for your order and a clear statement that you want to opt out. If you opt out, the rest of these Terms still apply.
22. If Part of This Arbitration Agreement Is Unenforceable
If a court decides that the class action waiver cannot be enforced for a claim, that claim must go to court and not arbitration. If any other part of Sections 19 to 21 cannot be enforced for a particular claim, only that claim goes to court, and all other claims stay in arbitration.
23. Indemnification
You agree to defend and hold harmless Tinctery and its owners, employees, contractors and suppliers from any claims, losses and costs, including reasonable attorneys' fees, that arise from your breach of these Terms, your misuse of the Website or Products, or your violation of any law or anyone else's rights.
24. General Terms
24.1 Governing Law. These Terms are governed by the laws of the State of California, without regard to its conflict of law rules, except where the Federal Arbitration Act applies. Subject to Sections 19 to 22, any court action will be brought in the state or federal courts in Los Angeles County, California.
24.2 Force Majeure. We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, carrier or customs delays, supply chain problems, internet or payment outages, government actions or public health emergencies.
24.3 Electronic Communications. You agree to receive order, shipping, subscription and customer service messages from us by email. These messages meet any legal requirement to be in writing. You can unsubscribe from marketing emails at any time.
24.4 Other Terms. These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, are the entire agreement between you and us. If any part of these Terms cannot be enforced, the rest still applies. Our failure to enforce any right is not a waiver of it. We may transfer these Terms if our business is sold or merged. You may not transfer your rights under these Terms. Headings are for convenience only. Sections that by their nature should continue after these Terms end, including Sections 2, 11, 14, 15 and 17 to 24, will continue to apply.
